Transformations in rent regulation

The recently approved decree, which comes into force this Wednesday, presents significant measures that affect housing and urbanism. Among the new features is the new regulation of seasonal rents, which will be forced to respect a price cap, a measure that seeks to protect the tenants.

Definition and regulation of seasonal rents

Traditionally, seasonal rentals were short -lived contracts, between one and 11 months. However, with the increase in the practice of chaining contracts, the new regulations change the paradigm. Instead of the duration, it will be the purpose of the use of the home that will determine if a limit is applied to the price.

Practical examples

To illustrate this situation, let’s imagine that someone wants to rent an apartment on the coast during the summer. If the goal is purely recreational, the price will not be subject to regulation. However, if the rent is for work or study reasons, then the price cap will be applied.

Conditions and requirements in contracts

The new regulations require that contracts include specific information, such as the reason for the rent and permanent residence of the tenant, which must be different from the rented housing. In addition, a clear definition of fraudulent contracts is established, banning misleading clauses that violate the rights of tenants.

Municipal Control Mesures

The decree also empowers councils to restrict seasonal rents in specific areas or even throughout the municipality, a measure that seeks to deal with real estate speculation.

Limitations in room rental

Another important new feature is the regulation of room rental. In areas with high residential demand, the total price of rooms of rooms of the same property will not be able to exceed the stable stable for the full home. In addition, the minimum surface standards per person are respected.

Protection of public housing

The decree also guarantees the continuity of officially protected housing in areas with high demand, automatically extending their classification to prevent them from falling into the hands of speculation.

New Housing Inspector Function

The figure of the Housing Inspector is introduced, who will have the responsibility to verify that the contracts are fulfilled, detect frauds and propose sanctions. This figure will carry out regular controls and prepare reports on possible irregularities.

Update of the registration of large holders

Finally, the registration of large holders will be expanded to include not only companies, but also individual owners with five or more real estate in tensions. They will all have to register and report on their property.

These reforms not only seek to regulate the rental market, but also to protect the rights of tenants and guarantee more just access to housing in a context of increasing economic pressure.
