The current situation of reprisals in Catalonia

The updated figures for reprisals in Catalonia show that, of the 1,168 activists and demonstrators reprisaled for defending Catalonia’s independence, a total of 419 are considering asking for amnesty. These figures have been provided by the organization that represents them, Alerta Solidària, as part of the wait for the definitive approval of the amnesty law for the events of the Process by the Congress of Deputies. Most of these individuals face accusations of disorder and assault against the authority, crimes that are included in the amnesty rule and that the judges will be able to apply once it is published in the BOE, which is expected to will happen this friday

Results of legal proceedings

Of those retaliated against, approximately 51% have had their proceedings dismissed, while 152 people have been acquitted by the courts. This count includes the 12 CDR accused of terrorism in the Judes operation, but not the pro-independence politicians.

Reactions and follow-up

Alerta Solidària has announced that it will monitor the application of the amnesty rule for the events of 1-O, although it has warned about the need to avoid triumphalist speeches that could disenchant the pro-independence popular base. In addition, he emphasizes that this law does not represent a step towards independence nor does it disable the State’s tools for political repression.

According to Alerta Solidària, of the 571 people who continue with their open case, 143 are in the investigation phase, 127 are awaiting trial, 12 are awaiting sentencing, and 137 have received full or partial convictions, of which requested the Prosecutor’s Office and other accusations.

Civil society support

The anti-repressive organization highlights the role of organized civil society in supporting those retaliated against, with public donations to the Solidarity Fund that have been used to pay fines and lawyers for those reported and arrested.

Possible amnesties

In addition to the activists, the police officers denounced for their actions during 1-O could be the first to be amnestied, since it is not expected that judges and courts will put obstacles to the application of the rule. This contrasts with the situation of pro-independence politicians, where the Supreme Court and the National Court are expected to put obstacles to the amnesty.
