The Superior Prosecutor of Catalonia rejects Vox’s complaint
The Superior Prosecutor of Catalonia has rejected the complaint filed by the Vox parliamentary group against the members of the JxCat Parliament Bureau and the CUP. The complaint was based on the admission to procedure of the Popular Legislative Initiative (ILP) which called for the lifting of Catalonia’s declaration of independence. According to the Prosecutor’s Office, there are insufficient grounds for the complaint and has asked the Superior Court of Justice of Catalonia not to admit it to proceedings (https://www.softcatala.org/resum-de-textos-en-catala /).
The Popular Legislative Initiative (ILP)
The ILP that asked to lift the declaration of independence of Catalonia was presented by Solidaritat Catalana per la Independència (SI) and was approved with the votes in favor of Junts and the CUP, despite the refusal of the PSC-Units and the abstention of ERC. The admission to the ILP procedure was controversial, but the Prosecutor’s Office considers that there has been no crime of prevarication on the part of the members of the Parliament Bureau.
The precautionary measures requested by Vox
Vox had requested as precautionary measures that the Bureau of the Parliament be required to slow down the processing of the ILP. However, the Prosecutor’s Office does not consider these measures to be necessary and has rejected the complaint in its entirety (https://www.softcatala.org/resum-de-textos-en-catala/).
The new Bureau of the Parliament
With the advance of the Catalan elections, the legislative proposal of the ILP will have to be evaluated by the new Bureau of the Parliament that conforms. This task will be complicated, since pro-independence parties have lost representation and pro-Spanish parties such as the PP and Vox have grown. The processing of the ILP seems unlikely with the new composition of the Parliament (https://www.softcatala.org/resum-de-textos-en-catala/).
Vox’s imputations and considerations
Vox had requested that a statement be taken from the lawyer Xavier Muro and that members of the Bureau of the Parliament Anna Erra, Aurora Madaula (JxCat) and Carles Riera (CUP) be cited as investigated. The party considers that the admission to the ILP procedure is unconstitutional and that the Bureau of the Parliament had the obligation to not admit it. However, only Anna Erra has been re-elected deputy in the elections.
The proposed law for the Declaration of Independence of Catalonia
The ILP proposes that the decision to declare the independence of Catalonia corresponds to the people of Catalonia and the Parliament of Catalonia. The text seeks to empower the Government to negotiate the international recognition of the declaration of independence. However, with the new composition of the Parliament, it seems unlikely that this legislative proposal will advance (https://www.softcatala.org/resum-de-textos-en-catala/).
