Administrative fine of 750,000 euros
Commitment to home care
In Comú Podem, PSC, ERC, Junts and the CUP have agreed to study with the Department of Labor the case of the home assistance company Monserveis. This company has been sanctioned with an administrative fine of 750,000 euros for having workers without a contract or Social Security registration.
Commitment of the CGT
The CGT, through its general secretary in Berguedà, Josep Cara, has expressed its commitment in this matter. In a press conference in Parliament, Cara detailed that work will be done to obtain the payment of the fine imposed on Monserveis and it is considered to strengthen the Labor Inspectorate in home care services.
Labor exploitation in the sector
The CGT has highlighted the labor exploitation situation that occurs in the home care sector. According to the union, Monserveis has used legal engineering to avoid paying the fine, creating a precedent that encourages labor exploitation.
Meetings with parliamentarians
The parliamentarians of the different parties have shown a good reception to the proposal of the CGT. A dialogue has started to find solutions and guarantee the collection of the fine. In addition, the possibility of strengthening the Labor Inspection in this sector will be studied.
Precedent for labor exploitation
The situation in Monserveis has generated concern for the message that is being transmitted: labor exploitation can go unpunished. The union has highlighted the responsibility of the State in assuming the financial sanctions instead of the offending company.
History of the Monserveis case
The Monserveis case goes back five years, when the CGT denounced the company’s labor exploitation practices. Despite the conviction of the owner, Xavier Pubill, to less than two years in prison, he did not go to prison. The CGT has highlighted Fogasa’s involvement in assuming the costs set in the court rulings.
Lorena Ospina, from the trade union section of Monserveis, was also present at the appearance in Parliament.
