The Constitutional Court annuls agreements of the Parliament of Catalonia
The Constitutional Court (TC) has issued a unanimous ruling in response to an appeal for protection from the PSC, declaring the nullity of the agreements of the Board of the Parliament of Catalonia of April 18 and 19, 2023. These agreements referred to the regulation transitional option for telematic voting until a reform of the Regulations of the Parliament of Catalonia is carried out.
This decision of the TC arises as a result of a judicial battle between the PSC and Lluís Puig, former Minister of Culture in exile since 2017, over telematic voting. The ruling of the TC invalidates the agreements adopted by the Parliament in response to a previous ruling of the TC, which also annulled the telematic vote because the delegation did not conform to the assumptions contemplated.
Impact on the constitution of the new Parliament
The TC’s decision took place on the same day that President Pere Aragonès called the plenary session to constitute the new Parliament for next Monday, June 10. This plenary session will include the election of the Board.
A week after the setback of the guarantee court, the Parliament Board adopted a political agreement to allow Puig to maintain his vote through a new means: temporary telematic voting. However, the TC has maintained that the Parliament could not accept this authorization of Lluís Puig’s telematic voting procedure, considering that the right of the PSC to exercise representative functions with the requirements established by law has been violated, in connection with the right of citizens to participate in public affairs through their representatives.
