Ruben Wagensberg’s lawyer denounces the use of Pegasus in the case against Democratic Tsunami

Complaint for Espionage and Use of Pegasus Software

On Friday, Ruben Wagensberg’s lawyer, Andreu Van den Eynde, presented a brief in the Supreme Court in which he accuses the National Intelligence Center (CNI) of using the Pegasus software to spy on the independence movement in the framework of the judicial case against Democratic Tsunami. Van den Eynde, defender of Esquerra Republicana deputy and social activist Ruben Wagensberg, who is being investigated for terrorism, alleges that the CNI used Pegasus espionage to support the accusation of terrorism against the defendants.

The lawyer requests the Supreme Court to declassify the CNI investigation related to Tsunami Democràtic, certifying that the CNI illegally participated in the investigation of the events, as did the State security bodies and forces required by the Supreme Court within the framework of this same cause.

Reinterpretation of the Facts and Threat to Civil Rights

In the letter, Van den Eynde assures that the case affecting Wagensberg presents a ‘clear reinterpretation’ of the law to classify the events under investigation as terrorism. Furthermore, it warns about the threat posed to the exercise of the right to protest by charging those investigated by Tsunami Democràtic with terrorism, considering that this criminal procedure ‘is a disproportionate reaction that attacks the civil and political rights of citizens and discourages their participation. free expression’.

Support for Wagensberg and Peaceful Nature of the Demonstrations

Van den Eynde also highlights Wagensberg’s career as a social activist and in defense of human rights, informing the Supreme Court about the manifesto of support signed by more than fifty personalities, including three Nobel Peace Prize winners, denouncing the case against Tsunami Democràtic . Likewise, she recalls the completely peaceful nature of the Tsunami Democràtic demonstrations, stressing that their objective was ‘at all times democratic and non-violent protest’.
