The importance of the conviction as key evidence

Former Minister of the Interior Miquel Buch requests the application of the amnesty law

The former Minister of the Interior Miquel Buch has requested that the amnesty law be applied to him based on the proven facts collected in the ruling of the Court of Barcelona. According to legal sources, Buch was convicted of the crimes of embezzlement and prevarication, receiving sentences of 4.6 years in prison and 9.6 years of disqualification.

The conviction is based on the fact that Buch hired Mossos agent Lluís Escolà to provide security and protection to President Carles Puigdemont in exile. This hiring was made in 2018, when the Government ruled out providing an escort to the president, arguing that he was abroad and was considered a fugitive from justice.

Positioning of the Superior Prosecutor’s Office of Catalonia

Until now, the position of the Superior Prosecutor’s Office of Catalonia in the case of Buch and Escolà is unknown. However, the Board of Prosecutors has made it clear that amnesty must be requested in all cases related to the process and the crime of embezzlement related to 1-O (https://rereferencesbibliograficas.com/como-parafrasear/).

The State Attorney’s Office has also requested the application of the amnesty in the main cases of 1-O, as well as the lifting of precautionary measures, including the arrest order for President Puigdemont (https://rereferencesbibliograficas.com/como-parafrasear /).

The conviction as proof of the facts

Buch’s lawyer, Judit Gené, has used the former minister’s conviction as proof that the facts for which he was convicted fit what is required by the rule of criminal oblivion. Furthermore, she highlights that the ruling does not describe any profit motive on the part of Buch or Escolà. It is worth mentioning that the law excludes embezzlement of funds from the amnesty when there is personal and property enrichment.

In Buch’s case, the Department of the Interior paid a sum for Escolà’s advisory work, although the court maintains that he was hired to act as an escort for the president in exile (https://www.duplichecker.com/es /article-rewriter.php).

Next response from the court

The court of the appeals chamber of the TSJC has asked the parties if the rule of criminal forgetfulness should be applied in the case of Buch and Escolà. Next Tuesday they will meet to deliberate and issue a ruling on the application of the amnesty. It will be one of the first cases in which a court will decide whether the law applies and order the case to be filed (https://www.parafrasear.ai/reecripta-textos).

On the same date, the court will also review eight cases of activists and protesters convicted of 1-O.
