This measure seeks to recognize permanent incapacity for those suffering from silicosis, a disease that mainly affects the lungs and is caused by the inhalation of silica particles. This initiative represents an important step in the recognition of workers’ rights and the protection of their occupational health.
Silicosis and Permanent Disability
Silicosis is a disabling disease caused by the inhalation of silica particles, which can seriously affect the health of workers exposed to this substance in certain professions. This disease is progressive and has no treatment, and its effects manifest themselves over the years. Workers may be affected by symptoms such as bronchitis, among others, and their health may deteriorate irreversibly. This new legislative initiative seeks to recognize the situation of total permanent disability for workers with first degree silicosis, providing them with the necessary financial support to deal with the consequences of their disease.
Type of Permanent Disability and Application Procedure
Permanent disability is an economic aid provided by the Social Security to those people who, due to an illness or accident, see their working capacity reduced or are forced to abandon their work activity. There are different types of permanent disability, such as total, absolute and major disability, each with its own characteristics and requirements. To apply for permanent disability, it is necessary to submit an application to the National Institute of Social Security, which will then examine the situation and make a decision. In case of disagreement with the resolution of permanent incapacity, the interested party has the right to appeal to the Superior Court of Justice.
