A Hopeful Vision
The defender of the former president of the Generalitat, Carles Puigdemont, Gonzalo Boye, has expressed his confidence in the positive evolution of Puigdemont’s legal situation. According to Boye, the prospect of crucial support from the Supreme Court and the implementation of an amnesty law could free Puigdemont from precautionary measures and allow him to return, coinciding with his role as Junts+ Puigdemont per Catalunya candidate .
In an interview with Catalunya Ràdio, Boye has indicated that the TS will probably lift the precautionary measures in application of the amnesty, and will subsequently request advice from the Court of Justice of the European Union (CJEU) and the Constitutional Court before taking measures additional
A Considered Legal Action
Boye has urged trust in the Supreme Court’s decision on amnesty, assuring that it will act impartially and appropriately in light of the legal circumstances.
Regarding the support of the general counsel of the TJUE to Puigdemont and former councilor Toni Comín in his appeal against the decision of the European Parliament, Boye has highlighted the importance of this support as a determining factor in the validation of his position.
Implications of CJEU Support
Boye has stated that the support of the advocate general of the CJEU underlines the lack of legal basis in the past actions that questioned the legitimacy of Puigdemont and Comín as MEPs.
In addition, he pointed out that this support reaffirms that taking the oath of office to the Spanish Constitution is not a precondition for exercising the position of MEP.
